Their presentation, entitled Impact of Broadest Reasonable Interpretation in Inter Partes Review, focused on key developments with respect to the widely popular proceedings, and provided practice pointers on how Petitioners and Patent Owners alike can benefit from these developments. Ben and Chris explained recent opinions of the Federal Circuit and the Patent Trial and Appeal Board dealing with the standard of claim construction—the broadest reasonable interpretation—and how this standard appears to be merging towards the standard of claim construction applied by the District Courts in patent infringement actions.
