Weinberg of RatnerPrestia Published in IP Law360

Stanley Weinberg, Of Counsel with RatnerPrestia, recently published, “Roadblocks to Establishing Personal Jurisdiction” in the May 18, 2009 edition of IP Law360, a daily online news source that covers the entire spectrum of every practice area.
Mr. Weinberg’s article relates to a case, Medical Solutions, Inc. v. C Change Surgical LLC, 541 F.3d 1136 (Fed. Cir. 2008), that was decided by the U.S. Court of Appeals for the Federal Circuit involving the issue of demonstrating personal jurisdiction, which plaintiffs face in every case. The Federal Circuit held that the activities upon which the plaintiff based personal jurisdiction were not sufficient because they did not fall within the ambit of the patent claims -- that is, they did not infringe the claims.
