Mr. Massina counsels clients in all aspects of intellectual property law to develop a comprehensive strategy which maximizes the value and advantages of the client’s intellectual property while minimizing risks and barriers associated with competitor’s rights.

 

Mr. Massina works with clients to actively monitor their intellectual property portfolio to identify areas where competitors may be encroaching on the client’s rights or areas where the client may desire additional protection.  A recent portfolio analysis helped a client identify patents which were being infringed by a competitor.  Upon assertion of those rights, the competitor agreed to stop selling or offering for sale the infringing product and paid a royalty for past infringement.  Further strategy was implemented to file additional patent applications to cover potential design arounds and related products.  This comprehensive strategy helped the client to protect its current products and created additional market barriers for emerging commercial opportunities.   

 

Mr. Massina also fosters an active role in his client’s product development process.  Through his early involvement, Mr. Massina helps clients identify and analyze rights held by competitors.  This early analysis allows clients to implement a product design which minimizes potential infringement risks associated with the competitor’s rights.  Additionally, Mr. Massina assists clients in analyzing the validity of competitor’s patents, thereby providing additional avenues to reduce potential infringement risks.

 

Mr. Massina received a Bachelor of Science in Mechanical Engineering from Villanova University and his Juris Doctor from Hofstra University School of Law where he served as a research editor for the Labor Law Journal.
